Hi Guys,

Very new to this, so any help is very much appreciated. 

I have received a Claim Form for Lowell Portfolio 1 LTD from Northampton county court business centre, for an alleged outstanding BT broadband debt of £290.00 from 5 years ago.

There was a a dispute with BT regarding broadband, not providing the service and speeds offered.

I am not sure the best way to respond to this.  I have further information, but not sure what is relevant/needed.

You need some legal advice.  You could try reposting on the UK Business Forum legal section as I'm not sure any solicitors respond to posts on this forum, sorry.


ultimately if you don't correspond it won't go away and they could get a CCJ against you and start recovery proceedings.  You will no doubt need to prove the debt was disputed at the time and reach a resolution.


Alternatively you could chalk it up to a bad experience and pay it but get some legal advice first.

Hi

I have received a county court judgement in default, in todays post from the bulk centre in Northampton. The judgement relates to a debt which Lowell have failed to demonstrate they own. I received no claim form or any other documentation from the court  prior to this. Lowell corresponded with me some months ago and failed to provide any proof  that they owned this alleged debt, despite this being requested.

Would I be right in completing a form N244 and stating that I did not receive the court claim form?  I would like this judgement set aside.

It is despicable that an outfit like Lowell can obtain a CCJ against someone with no proof that they own the alleged debt.

All suggestions gratefully received.

They probably settled. Usually do what theye is info about the case on the internet. Can the person who corresponded in the past check with Mr Hanchette?

Sorry I might not have typed it out correctly , the paperwork we received was from County Court Business Centre in Northampton which is photocopied with a County Court Stamp. The high court notice of enforcement was transfered from a Judgement in the Bradford County Court ... To me who is not legally trained whatsoever does not sound right ... Please Help

Hi again , I have just noticed that out CCJ was heard at a County Court Business Centre not an actual County Court, there is a county court stamp on the paperwork . Apparently the CCBC does NOT phsyically have hearings.. How the hell were we ever going to make a defence or response anyways ?? Please Help URGENT ...
