Inheritance after discharge
« on: Mar 07, 2013, 12:24:56 AM »
Hi all,

I was discharged in December 2012. My mother died in February of Penumonia. No warning, no outward signs. Just passed out one evening and died the next Morning.

I have since found out that I am the executor of her will and the sole beneficiary. The will has gone to probate as per the norm. So: Should I expect a call from the OR as in a request to part with some cash? Or do I now just get on with my life such as it is.

Thanks for the help.

Benny H.

Hi there Benny H

Sorry to hear about your Mother. If you were already been discharged from bankruptcy at the time your mother died and you became the beneficiary of her will then you will not have to give any of your inheritance to the OR. The bankruptcy windfall clause ceases to exist on the day you are discharged.
