Voluntary Surrender and Council Tax

At the end of October 2012 I voluntary surrendered my jointly owned property to the mortgage company.
I have not lived there for over 2years now and since i left my ex has not let me have access to the house, removed my key and not cooperated in any way with removing me from the mortgage.
He has in this time payed the mortgage and all bills. Including the council tax where he claimed single persons council tax.
The council today have wrote to me to say that as no one is living in the property I will still owe them council tax until it is sold.
Is the correct that I should be paying this under the above circumstances?
